ARTICLE 1.
NAME AND PURPOSE
Quail Valley Country Club, LP (the "Owner"), and operator of Quail Valley Country Club (the "Club"), at its sole discretion at any time, may establish additional Rules and Regulations and may modify or rescind existing Rules and Regulations set forth herein. Decisions made by the Owner regarding the interpretation and application of these Rules and Regulations shall be final and binding on all Persons using the Club Facilities. Capitalized words not defined in these rules and regulations shall have the same meaning as set forth in the Membership Bylaws for Quail Valley Country Club (the "Bylaws"), as they may be amended from time to time, unless the context shall require otherwise.
FORWARD
It is the intent of the Owner to limit these rules and regulations
to the minimum required for the mutual enjoyment of the Club
by all its Members and their guests. The enforcement of these
rules and regulations is placed primarily in the hands of a
carefully selected and trained staff for the good of all Members.
Our staff's principal objective is to assure all Members the
courtesies, comforts and services to which Members of a private
country club, are entitled. It is further the duty of the membership
of the Club to know its rules and regulations and to cooperate
with the Board of Advisors management and staff in the enforcement
thereof.
ARTICLE 2.
GENERAL
The Manager of the Club, or his staff, shall have full and complete charge of all Club Facilities and properties of the Club. Use of the Club Facilities is reserved for members, eligible family members, their guest and individuals or groups specifically approved by Owner management. A Member's right to use various facilities (club house, golf courses, fitness center, and swimming pools, etc.) is determined by the class of membership held by the Member, as described in the Bylaws.
2.1 Hours of Operation.
The Owner reserves the right to establish, amend, or modify the hours of operation of the Club and any component or individual facility thereof.
2.2 Conduct.
- All Members, their Family members, and their respective guests shall abide by the Bylaws and these Rules and Regulations.
- If any Member, his or her Family members or any of their respective guests conducts himself in an unbecoming manner or knowingly violates any Club policy or rule such Person may be denied service by Owner and/or such Person and others responsible ________be sanctioned as provided in the Bylaws and these Rules and Regulations.
- Members, their Family members, and their guests shall give due consideration of the rights and comforts of others at all times while at the Facilities.
- The Club's hours of operation will be established and published by Owner considering the season of the year and other circumstances.
- All food and beverages consumed at the Facilities must be furnished by Owner and may be consumed only in areas designated by Owner.
- Absolutely no fireworks are permitted at the Facilities unless part of a fireworks exhibit organized and conducted or sanctioned by Owner.
- No Member shall use or furnish the membership list of addresses for the purpose of solicitations.
2.3 Member's Club Accounts.
- Dues, food and beverage charges, purchases, equipment rentals, and other charges incurred by a Member, his or her Family members or their respective guests may be billed to the Member's Club Account as determined by the Owner.
- All expenses, including costs and attorneys' fees, incurred by Owner for checks returned by the Member's bank or a guest's bank shall be borne by the responsible Member.
- Any Member desiring cancellation of any service must do so by written notice to Owner. The Member shall continue to be charged and shall be obligated to pay for any service provided prior to receipt of written notice of cancellation. No cancellation of service shall be retroactive.
2.4 Club Equipment.
- No property or furniture of the Club shall be removed from the room or other area in which it is placed without the prior approval of Owner.
- No Club property shall be loaned or removed from the Facilities without prior written permission from Owner.
- A Member shall be responsible for damage to Club property resulting from misuse by the Member, his or her Family members, or their guests. All repair or replacement costs may be charged to the responsible Member.
2.5 Unauthorized Entry.
Maintenance and equipment buildings and other service areas are off limits to Members, their Family members and their respective guests unless accompanied by an authorized employee of Owner.
2.6 Alcoholic Beverages.
No alcoholic beverages shall be brought onto or removed from the Facilities by a Member, his or her Family members, or their respective guests, nor shall any alcoholic beverages be served or consumed by a Member, his or her Family members, or their respective guests at the Facilities in violation of Texas law.
2.7 Traffic and Parking.
- Vehicles shall be parked only in appropriate parking spaces and in strict observance of any traffic regulations that may be established by the Owner. Vehicles, which are parked in reserved, restricted or unmarked areas, may be removed at the expense of the responsible Member.
- Recreational vehicles ("RVs") and mopeds, minibikes, all terrain vehicles and other unlicensed motorized vehicles are not permitted at the Facilities without the permission of the Club. Motorcycles and bicycles shall be restricted to parking areas only and are subject to the same rules and regulations as other vehicles. Only golf carts and golf course maintenance vehicles shall be permitted on the golf courses.
2.8 Solicitation.
- No advertisement, solicitation, petition, or notice shall be posted at the Facilities without prior approval of Owner.
- No business activity or solicitation of any kind shall be conducted at the Facilities without prior approval of Owner.
2.9 Pets.
No dogs or other pets (with the exception of Seeing Eye dogs) are allowed at the Facilities except under special circumstances with prior authorization of Owner. A Member is responsible for any damage or injury caused by an animal owned by or brought upon the Facilities by such Member, his or her Family members, or their respective guests. Any animal, which is brought onto the Facilities, shall be kept on a leash or otherwise under control at all times.
2.10 Prohibited Activities.
The Club shall have the right and power to prohibit any games, sports or other activities that it may, in its determination, consider harmful to the interests of the general membership and/or the Club.
2.11 Personal Property.
The Club will not be responsible for any damage to or loss of personal property, regardless of the cause. Any personal property left at the Facilities without payment of storage fees for six (6) months or more may be sold by Owner, with or without notice, at a public or private sale, or may be otherwise disposed of and the proceeds, if any, shall belong to Owner for the use of the Club.
2.12 Guest Privileges.
All Members and their Family members shall be entitled to guest privileges subject to the provisions herein, shall be required to pay applicable guest fees and charges, and shall be subject to such additional rules and regulations as are established from time to time by the Owner. A Member or his or her Family member shall be required to register his or her guests, either in person, by telephone, or by facsimile, prior to using the Facilities. Guests must check in upon arrival at the Club. A Member shall be responsible for the conduct of his or her guests and those if his or her Family members at all times while at the Facilities. Guest privileges may be denied, withdrawn or revoked at any time for reasons considered sufficient at the sole and absolute discretion of the Owner.
Except as otherwise provided herein or permitted by Owner at its sole and absolute discretion, no guest shall use the Facilities unless accompanied by the Member or Family member of whom he or she is a guest. Guest fees and other charges incurred by the guest shall be billed to the sponsoring Member's Club Account or may be paid for with cash or credit card. Guests will be entitled to use the Facilities only in accordance with the privileges of the category of membership held by the sponsoring Member.
2.13 Family Privileges.
- Owner reserves the right to cancel the privileges of any Family member for failing to abide by the terms and conditions of the Bylaws and these Rules and Regulations as may be amended from time to time.
- Persons under ten (10) years of age must be accompanied by a parent or other Person fourteen (14) years of age or older who will assume responsibility for the former's safety and behavior while at the Facilities unless otherwise approved by Owner.
- Persons under the legal age for the consumption of alcohol are not allowed in any bar area (excluding the grill and dining room) unless accompanied by a parent who is of such legal age.
- Persons under the age of eighteen (18) are not allowed to use the Facilities after 11:00 p.m. unless accompanied by an adult Member or Family member.
- A Member shall be responsible for the conduct of his or her Family members at all times while at the Facilities.
2.14 Parties/Reservations.
Certain facilities of the Club may be available for private parties from time to time. Arrangements for private parties or special parties for the Members or Member-sponsored groups should be made through the Club management in advance. If an unusual number of people are involved and/or whenever special service of any kind is desired, the Club management shall establish guidelines regarding notice, operations, additional services, and hours. No performance by entertainers will be permitted at the Facilities without the permission of Owner.
2.15 Liability.
Members, their Family members, and their respective guests shall use the Facilities at their own risk and shall assume sole responsibility for their personal property. The Owner, its partners, officers, employees, representatives and agents shall not be held liable for personal injury to any Person, nor for loss or damage to personal property used or stored at the Facilities whether in lockers or elsewhere. Each Member shall be legally and financially responsible for his or her acts or omissions as well as those of his or her Family members and of guests of such Member and his or her Family members. Each Member shall indemnify and hold the Club, the Owner and its partners, officers, employees, representatives and agents harmless from any loss, cost, claim, injury or damage incurred by the Member, his or her Family members or their respective guests, or arising out of the conduct of the Member, his or her Family members or their respective guests.
In any action under the Bylaws or these Rules and Regulations arising out of any event operated, organized, arranged or sponsored By Owner, the prevailing party shall be entitled to be reimbursed by the non-prevailing party for all costs and expenses incurred by it, including court costs, attorneys' fees, travel and other costs through all trial and appellate proceedings.
2.16 Membership Cards.
- A Membership Card indicating the Member's name, Club Account number and the type of membership, and containing the name of the authorized user, shall be issued to each Member and to the members of his or her Family. Membership Cards will not be issued to Children under the age of ten (10). Members and their Families must have their Membership Cards with them at all times while using the Facilities.
- A Membership Card may not be used by any Person other than the Person to whom it is issued. Membership Cards are nontransferable.
- In the event of a lost or stolen Membership Card, the Club must be notified immediately and the Member's Club Account may be cancelled as determined by Owner. In the event the Member's Club Account is cancelled, the Club will issue a new Membership Card and Member number. Until notification of card loss or theft is received in writing by Owner, the Member shall be responsible for all charges placed on the Club Account. For each new Membership Card replaced, a charge covering the cost of the replacement card will be placed on the Member's Club Account in such amount as determined By Owner.
- Each Member shall receive such certificates, identification decals, and other insignia as the Club may from time to time designate and shall display such insignia as required by Owner.
2.17 Reservations and Cancellations.
- Dinner reservations are requested for use of the food facilities as determined By Owner. The courtesy of providing notice of necessary changes or cancellations is requested no later than 3:00 p.m. on the day of the reservation, or as specified for social events.
- For all functions of the Club held in the dining rooms of the Club, tables will be assigned on a first call, first choice basis.
- Reservations for dining will be held for only fifteen (15) minutes after the reserved time.
2.18 Gratuities.
- A gratuity in an amount determined by Owner or percentage, will be added to all food and beverage sales for the convenience of the Member. Gratuities for locker-room attendants, bag storage and other related staff is expected when special and/or services are requested and received.
- At the sole and absolute discretion of the Owner, the Owner may send a letter providing an opportunity for Members to contribute to a holiday fund for employees and a suggested contribution of which payment will be voluntary. The Club employs many people ranging from those in office administration to those in clubhouse services and golf course maintenance, and such holiday fund provides the membership with an opportunity to show their appreciation of the employees' efforts. The Club shall be responsible for the distribution of these funds.
2.19 Attire.
- It is expected Members will choose to dress in a fashion befitting the surroundings and atmosphere or their Club. It is also expected that Members will advise their guests of the dress requirements. From time to time, exceptions to the dress rules may be made as published by Owner.
- Casual attire in good taste is the appropriate attire in the formal dining room. Shorts, jeans, and sports hats and caps are not permitted. Dress restrictions may be imposed or waived at the Owner's discretion for specifically designated events.
- Shirts and shoes are required in the dining rooms and social areas of the club.
2.20 Club Services and Activities.
- The Club reserves the right to sponsor various social, cultural and recreational events at which time use by Members may be restricted.
- The Club may sponsor various social, cultural and recreational events in which all Members may be invited to participate. Activities will be publicized in the Quail Valley News.
- Reservations are required for most social events of the Club and are taken on a first come, first served basis by pre-registering with the appropriate personnel of the Club. Cancellation of reservations after any published deadline for cancellation may result in the Member being charged a fee as determined By Owner.
- The Club wishes to encourage the use of the clubhouse facilities by Members for private parties. A Member must make reservations with the Club for available dates and arrangements and must assume full responsibility for the party and for the conduct of such Member's guests in accordance with the Bylaws and these Rules and Regulations.
- The Club may require the advance payment of a security deposit by the Member who assumes responsibility for a private party. The Members sponsoring the party shall be responsible for any damage caused by the installation and removal of party decor.
ARTICLE 4.
SWIMMING POOL
4.1 Registration.
All Members, their Family members, and their respective guests must register at the pool desk before entering the pool area. All Members and Family members must present their Membership Cards to the pool attendant for admission to the pool area. Members or their Family Members shall register their guests and shall be responsible for the payment of all appropriate charges. Failure to register or to pay guest fees may result in loss of pool privileges for the Member.
4.2 Hours of Operation.
- The pool hours shall be established and published by Owner and shall be subject to change as determined at the sole discretion of the Club and depending on utilization of the pool facilities by the Members. Absolutely no admission to the pool area and no swimming are allowed when the pool is closed.
- The pool and surrounding pool area will be closed during inclement weather. All users are responsible for their own safety in the pool and pool area during hazardous weather conditions. While the Club will attempt to warn users and close the pool when conditions dictate, under no circumstances shall the Club be held liable for failing to warm users of hazardous weather conditions or the need to vacate the pool area.
- During peak hours (afternoons and weekends), the Club may specify periods for adult swimming and diving and as a rest period for Children. No one under the age of sixteen (16) will be allowed in the pool during this time.
- The Club reserves the right to set aside designated time during hours of normal pool operation for special events or programs during which time, use by the Members may be restricted.
4.3 Pool Rules.
- Persons under the age of ten 10) and all minors who are unable to swim are not permitted in the pool area unless accompanied by a parent or other Person fourteen (14) years of age or older who agrees to assume responsibility for the child's safety and behavior, or unless otherwise approved by Owner. No child under the age of eighteen (18) years may use the pool unless a lifeguard is on duty.
- The diving area is for diving only; no recreational swimming will be allowed in this area.
- Non-swimmers may use lifeguard approved flotation devices but must remain in the shallow end of the pool. No other flotation devices may be used in the pool unless approved by Owner.
- Pool attendants shall have the authority to enforce all rules and regulations and to supervise the general conduct of all Persons in the pool area. Pool attendants shall have full authority to maintain order, reprimand, discipline, restrict, and evict any individual not complying with the rules and regulations.
- Showers are required before entering any pool.
- Radios, televisions, and similar electronic devices may be listened to if played at a volume that is not offensive to other Members, Family members, and their guests as determined by the pool staff.
- Snorkels, fins, masks, kick-boards, weights and inflatable devices are not permitted in the pool unless permission is obtained from the pool manager or their use is required for a class.
- Glass bottles, drinking glasses, and sharp objects are not permitted in the pool area.
- Animals, bicycles, and skateboards are restricted from the pool area.
- Running, wrestling, pushing, dunking, ball playing and noisy or other hazardous activity will not be permitted in the pool areas.
- Lifesaving and pool cleaning equipment should be used only for the purpose intended.
- Notwithstanding the presence of pool attendants, all Persons using the pool or pool area shall be responsible for their own safety and shall be deemed to have assumed the risk of using the pool or pool area, and agree by their presence in the pool area, that neither the Owner, its agents or employees, shall be held liable for any loss, injury or death arising out of the pool or pool area.
Only preschool children shall be permitted to use the baby pool.
Please do not unnecessarily talk to the lifeguards on duty.
Please do not take club towels into the pool area.
4.4 Illness, Medical Conditions.
- Persons are not permitted in the pool if they have a cold, cough, fever, infection of any kind, skin rash, inflamed eye(s), or are wearing bandages.
- Persons with physical or neurological disabilities, or a responsible adult accompanying that Person, must advise the lifeguard of such conditions.
4.5 Attire.
All Persons must wear suitable bathing attire while swimming; no cutoffs, dungarees or Bermuda shorts will be permitted.
4.6 Guest Pool Privileges.
- Guests are entitled to use the pool facilities upon registration with the pool attendant and purchase of a daily or weekly pool pass at rates determined by Owner. Members will be billed for all charges incurred by their guests, including, without limitation, daily fees, and food and beverage charges at the snack bar.
- No Member may sponsor more than five (5) guests for admission to the pool area per day. Guests need not be accompanied by the sponsoring Member when using the pool facilities; however, Members must obtain prior approval from the Club in the event the sponsoring Member will not be accompanying the guest.
- Guest privileges may be limited during peak periods as determined at the sole discretion of the Club.
ARTICLE 5.
GOLF RULES
5.1 Registration.
All golfers must register at the golf pro shop and pay all applicable guest, cart and usage fees before beginning play. Members are responsible for the payment of fees incurred on account of their guests.
5.2 Reservations.
- The hours of golf course play, practice range hours and pro shop hours will be posted in the golf pro shop and are subject to change, as determined at the sole discretion of the Club and depending on golf course and weather conditions. The golf professional in consultation with the golf course superintendent shall determine when the golf courses are playable and such decision shall be final and binding on all Persons using the golf course. No golf course play shall be permitted during any period that the course is closed.
- All players must be assigned a starting time through the golf pro shop. Starting times may be reserved by calling the Club during pro shop hours. All players' names are required for a starting time reservation. Premier Full Members, life, and (prior full and prior golf members), may reserve starting times up to ten (10) days in advance for weekdays, weekends, and holidays. Members subject to the required usage fee and limited to six times per year on the El Dorado and La Quinta golf courses may reserve starting times five (5) days in advance. Social Members subject to the required usage fee and limited to six times per year on the El Dorado and La Quinta golf courses may reserve starting times three (3) days in advance. Leisure Members subject to the required usage fee and limited to the Executive and Par 3 golf courses may reserve starting times two (2) days in advance. All starting times shall be assigned on a first come, first served basis.
- Players shall check in and register at the pro shop at least fifteen (15) minutes prior to their scheduled starting times or shall be subject to losing their starting times.
- The pro shop shall be notified of all cancellations at least twenty-four (24) hours prior to the scheduled starting time. Failure to so notify the pro shop may result in a cancellation fee being charged to the Club Account of the responsible Member equal to the amount of the fee charged for the Club's golf cart use.
- Weekday play is encouraged in threesomes and foursomes with singles and twosomes permitted during non-busy times. Fivesomes will be permitted provided all players are riding golf carts and the head Golf Professional determines the group will not disrupt the pace of play. Weekend play is restricted to threesomes, foursomes and approved fivesomes; singles and twosomes will be allowed when play permits, however, they will not be allowed to play through unless invited by the group in front of them. During peak play periods twosomes and threesomes may be filled by the pro-shop or starter.
- The Club may designate certain playing times for players eighteen (18) years old or younger.
5.3 Tournament and Clinics.
- The Club reserves the right to make the golf courses and practice range available for tournaments and clinics at which time use by non-participants may be restricted.
- Except during special events, only members of the golf professional staff are permitted to render golf instruction at the Club. Lessons should be scheduled through the golf professional. Lessons not cancelled at least twenty-four (24) hours in advance will be subject to charge.
- No golf tournaments of any kind, nor play by any group of five (5) or more Persons shall be permitted unless approved in advance by Owner.
- Any Member holding a membership which permits golf course play and with a handicap approved by the United States Golf Association ("USGA") shall be eligible to participate in Club Sponsored golf tournaments.
5.4 Equipment and Attire.
- Every player must have a set of golf clubs and a golf bag. No sharing of golf clubs shall be permitted.
- Proper attire is required for all players. Shirts or blouses with collars, golf or walking shorts and slacks and skirts (for women) are considered proper attire. T-shirts, tank tops, bluejeans, cutoffs, jams, or other athletic shorts and bathing suits are not permitted.
- Only soft spiked golf shoes or other approved shoes shall be worn on the golf course and practice areas.
5.5 Golf Cart Use.
- Golf carts shall be assigned at the golf pro shop at the time of registration. Players are currently allowed, at the discretion of the Club, to walk and carry their clubs.
- No vehicles other than golf course maintenance vehicles, golf carts, and private golf carts approved by Owner shall be permitted on the golf course. No electric pull carts, or pull carts of any kind shall be permitted on the golf course.
- Club owned golf carts are restricted to use on the golf course and practice areas. No club owned golf carts shall be removed from the Facilities at any time.
- Golf carts, whether Club owned or Member owned, shall be operated only by Persons sixteen (16) years of age or older with a valid automobile driver's license.
- No more than two (2) Persons and two (2) sets of golf clubs are permitted on golf carts.
- Golf carts shall remain on cart paths where directed. Drivers must observe and obey all signs, stakes, roped off areas and other markers used to guide carts. Golf carts shall not be driven or parked within thirty (30) feet of any tee, bunker, green, or hazard except on cart paths. When driving golf carts on fairways, care should be taken to avoid soft areas. Golf carts are not to be driven over sprinkler heads. Golf cart traffic and directional signs must be obeyed at all times.
- Golf carts are operated at the risk of the operator. The cost of repairing any damage to golf carts or the golf course resulting from improper operation will be charged to the Member in whose name the operator is playing at the time the damage occurs. An accident involving a golf cart or a player must be reported and recorded with the pro shop as soon as possible.
- Privately owned carts are allowed subject to the inspection and approval of Owner and to payment of the Private Cart fee. Carts must comply with standards established by Owner. A current private cart ownership sticker with the owner's membership number must be properly displayed on the cart at all times. Rules governing the use of private carts and fees associated with their use can be obtained from the Golf Shop.
- Violation of these golf cart rules may result in immediate suspension of playing privileges and ejection from the golf course.
5.6 Handicaps.
Handicaps are computed under the supervision of the golf professional in accordance with current USGA recommendations. The handicap committee and the golf professional will keep and record accurate records of scores turned in for full rounds played. Handicap adjustments may be made in compliance with USGA recommendations by the handicap committee.
5.7 Golf Course Play.
- Jogging, walking, bicycling, skating, roller-blading and walking of dogs are not permitted on the golf course or cart paths at any time. No fishing is permitted from golf course property. No feeding of ducks or alligators is premitted.
- All play shall start at the number one tee unless permission to start elsewhere is obtained in advance from the Club. All players must check in with the starter. Under no circumstances shall players start play from residences.
- Ball hawking is not permitted on the course at any time.
- No wading into water hazards shall be permitted. Balls may be retrieved only from the banks of water hazards.
- No player shall have more than one (1) ball in play at any time.
- All players shall repair ball marks on greens, replace divots, and smooth sand traps before moving to the next tee.
- All players should remain aware of the rights of others. It is the responsibility of each group to keep pace with the group ahead. If a group falls more than one complete hole behind the group ahead, each player in the group that is behind is required to pick up his or her ball and move forward into position. It is each group's responsibility to be observant of its position on the course and keep pace. It is also the responsibility of all groups to freely advise less observant groups if the pace of play is adversely affected by them. The ranger has the authority to keep play moving at the proper pace for all players' enjoyment. Repeated violations of the slow play guidelines will first result in formal notification and may result in restricted play privileges.
- Golf carts should not be parked in front of the green or in other areas that will impede the rate of play.
- When play of a hole is completed, Members shall leave the green promptly and proceed to the next tee without delay. Members shall do the scoring for the completed hole while the others in the group are playing from the next tee.
- The Club reserves the right to require instruction for Members who are beginners or inexperienced, prior to allowing them to use the golf courses. The intent of the Club is to assist Members in obtaining a level of skill and knowledge that will enhance the enjoyment of the game for them, as well as other Members.
- "Course closed" and "hole closed" signs are to be adhered to without exception.
- The rules of golf adopted by the USGA shall govern all play except as modified by the rules set forth herein.
- Players shall observe the rules of golf etiquette as adopted by the USGA a all times.
If lightning is in the area, all play shall cease and players shall return to the clubhouse as soon as possible. All players are responsible for their own safety during hazardous weather conditions. While the Club may, from time to time, attempt to warn players and/or require play to cease, under no circumstances shall the Club be held liable for failing to warn players of hazardous weather conditions or the need to cease play and return to the clubhouse.
5.8 Guest Playing Privileges.
- Guest play will be subject to approval of Owner. No Person who has been expelled from membership in the Club, and no Member or Family member, whose playing privileges have been suspended by Owner, shall be permitted to play as the guest of a Member.
- All players must be assigned a starting time through the golf pro shop. Starting times may be reserved by calling the Club during pro shop hours. All players' names are required for a starting time reservation. Premier Full Members, life, and (prior full and prior golf members), may reserve starting times up to seven (7) days in advance for weekdays, weekends, and holidays. Members subject to the required usage fee and limited to six times per year on the El Dorado and La Quinta golf courses may reserve starting times five (5) days in advance. Social Members subject to the required usage fee and limited to six times per year on the El Dorado and La Quinta golf courses may reserve starting times three (3) days in advance. Leisure Members subject to the required usage fee and limited to the Executive course may reserve starting times two (2) days in advance. All starting times shall be assigned on a first come, first served basis.
- House guest will be eligible for special pricing.
- All guest including house guest will be limited to golfing guest privileges of twelve (12) times per year.
5.9 Junior Golfers.
The golf professional shall administer a certification program to players under eighteen (18) years of age ("Junior Golfers"). Any Junior Golfer not certified by the golf professional shall be accompanied by his or her adult parents or an adult Member at all times during play on the golf course. Junior Golfers certified by the golf professional may play the golf course unaccompanied after 2:00 p.m. unless notified otherwise by the golf staff as determined at its sole discretion.
ARTICLE 6.
FOOD AND BEVERAGE
6.1 Service Hours.
The service hours of the different food and beverage departments shall be published in the "Operations" section of the Club's newsletter and may be changed as determined at the sole discretion of the Club.
6.2 Banquets and Special Functions.
- The food and beverage manager should be contacted for information and reservations regarding banquets and special functions.
- All reservations for banquets and special functions require a deposit payment.
- Available dates may be reserved up to one year prior to the requested date. A Member may refer a non-member for the booking of a special event.
- The number of guests attending must be guaranteed seventy-two (72) hours before the function.
- The food and beverage staff will prepare five percent (5%) more than the guaranteed quantity in case of extra attendance. The hosting Member is required to pay the guaranteed quantity cost as well as the cost of any additional service rendered above this quantity guarantee. Payment must be made in full in cash or by check on the day of, or first business day following, the function.
- All food and beverage charges are subject to a service gratuity charge and to applicable sales tax.
6.3 Cancellation Policy.
- The Club reserves the right, at its sole option, to cancel service or change reserved dates not less than ninety (90) days prior to the date of a reserved function. In the event of cancellation, the Club will refund one hundred percent (100%) of the room reservation deposit.
- Any Member who cancels a reservation more than one hundred eighty (180) days before the function date will receive a one hundred percent (100%) refund of the room reservation deposit. If a cancellation occurs after this 180 day deadline has passed, one hundred percent (100%) of the room reservation deposit will be returned if the Club rents the space for the cancelled date to a party of equal or greater revenue to the Club. Members must give notice of a cancellation in writing and no partial refunds are given for any reservations cancelled after the cancellation deadline, except as set forth above.
- A Member who cancels a reservation less than seventy-two (72) hours prior to the scheduled time of the event will be obligated to pay all costs of the event.
6.4 Member Restrictions.
- Members are not permitted in the kitchens or behind the bars at any time.
- No food or beverage shall be consumed at the Facilities unless purchased from the Club or approved in advance by Owner.
6.5 Liquor.
Liquor law violations are not permitted at the Facilities. It is illegal for any Person to bring alcoholic beverages onto the Facilities for the purpose of consumption or storage. It is also illegal to remove alcoholic beverages from the Facilities. The Club, at its sole discretion, may refuse to serve alcoholic beverages to any Member, his or her Family members or their respective guests for any reason. Minors may not purchase or consume alcoholic beverages anywhere at the Facilities.
ARTICLE 7.
REVOCATION
7.1 Revocation.
A membership may be revoked and the rights of any Person or Persons entitled to use the Club may be terminated for any of the following reasons:
- Commission of any felony or misdemeanor theft at the Facilities;
- Sixty-day delinquency;
- Willful destruction of the Club property, property of a staff member, Member, or his or her Family member or their respective guests, or the property of any Person at the Club;
- Fighting or other physical abuse and/or gross verbal abuse of staff, Members, Family members or guests.
- Continued and repeated violations of these Rules and Regulations; and
- Following suspension, if a Member or Family member again violates the rule that led to the previous suspension within twelve (12) months of the infraction, or if the Member or Family member violates any other rule that would result in suspension within twelve (12) months of the infraction.
